These Additional Number Service Terms (“Additional Number Terms”) are incorporated by reference into, and form an integral part of, CallApp’s Terms of Service. Terms used herein but not otherwise defined shall have the meanings ascribed to them in CallApp’s Terms of Service. The Additional Number Terms apply to and govern your use of CallApp’s additional number service (the “Additional Number”) and are in addition to the general terms set forth in CallApp’s Terms of Service. The Additional Number constitutes part of the Service, however the Additional Number Terms prevail in the event of a conflict with CallApp’s Terms of Service with respect to the Additional Number.
- The Service
The Additional Number is a second phone number which is associated with your CallApp account, allowing you to receive and make calls to mobile or landlines using the Service.
Subject to the limitations and restrictions provided in these Additional Number Terms, CallApp hereby grants you a limited, personal, non-exclusive, non-sublicensable, non-transferable, revocable right to use the Additional Number, on a device that you own or control, for the sole purpose of your personal, non-commercial use of the Additional Number.
Important: the Additional Number cannot be used for emergency calling. You must arrange alternative options to make emergency calls using your landline or mobile phone and must not rely on the Additional Number for emergency calling.
- Requirements
The Additional Number requires an online connection of your mobile device to the internet, such as Wi-Fi, 3G or 4G (the “Connection”). The Connection is not provided by CallApp, and you are solely responsible for obtaining and maintaining the Connection. All costs associated with the Connection are at your sole responsibility and expense, as dictated by your communications service provider (e.g. cellular carrier) and in accordance with its applicable payment terms. Use of the Additional Number with any Connection that is defective or not compatible with the Additional Number may result in partial or complete unavailability, interruption, or underperformance of the Additional Number, the Connection or other services utilizing the Connection. CallApp shall not be responsible or liable for any issues with the Additional Number and/or the Connection.
- Payment
The Additional Number is purchased by you as an auto-renewing monthly subscription that will include the assignment of a phone number for your use and the monthly minutes package you choose to purchase (the “Monthly Subscription”). You shall pay the fee for the Monthly Subscription through your app store (e.g. Google Play) or through a third party. The fee will be charged on a monthly basis from the date you first subscribe to the Additional Number and automatically on each monthly renewal thereafter, unless and until you cancel the Monthly Subscription. Fees and charges are non-refundable. The fee for the Monthly Subscription is not based on actual usage and there is no refund or credit for partial use. Minutes purchased but not used by the end of the applicable monthly period will expire.
The Monthly Subscription will continue unless and until you cancel it or if we terminate it. If you choose to cancel the Monthly Subscription, you may use the Additional Number until the end of the current monthly period for which you were charged and you will not be issued a refund for such period.
We may change the pricing of the Monthly Subscription by notifying you on the Service and such change will take effect when your Monthly Subscription is renewed.
- Acceptable Use
You represent and warrant that your use of the Additional Number is lawful, reasonable, does not violate any municipal, state, national, international or other laws, and does not violate the rights of any third party, including without limitation intellectual property rights and privacy rights.
Without limiting the generality of the foregoing, you further represent and warrant that you will not use the Additional Number for any of the following: reselling Monthly Subscription minutes; sharing Monthly Subscription between users, whether via a PBX, call center, computer or any other means; telemarketing or call center operations; in a way that circumvents the amount of minutes you purchased through the Monthly Subscription; unusual calling patterns inconsistent with normal, individual use, e.g. regular calls of short duration or calls to multiple numbers in a short period of time.
You understand and agree that you are solely responsible for your interactions and conversations with any third party through use of or in connection with the Additional Number and CallApp will have no liability or responsibility with respect thereto.
CallApp may, at its option, immediately terminate or suspend your use of the Additional Number and/or the Service if CallApp determines, at its sole discretion, that you are using the Additional Number not according to these Additional Number Terms.
- The Additional Number
You acknowledge and agree that you do not own or have a right to retain forever the Additional Number assigned to you, and you further acknowledge and agree that you may not port or transfer the Additional Number from the Service to another service provider. You acknowledge and agree that CallApp may from time to time, at its sole discretion, change the Additional Number assigned to you. The Additional Number assigned to you is provided “as is” and CallApp makes no warranty, representation or guarantee that it will be usable or “clean” when assigned or anytime thereafter.
- Warranties
The following provisions shall apply in addition to the provisions set forth in CallApp’s Terms of Service “Disclaimer of Warranties” section.
CALLAPP MAKES NO WARRANTY IN CONNECTION WITH YOUR ABILITY TO MAKE OR RECEIVE CALLS THROUGH THE ADDITIONAL NUMBER, NOR IN CONNECTION WITH THE QUALITY OF THE ADDITIONAL NUMBER OR OF ANY CALLS MADE OR RECEIVED THROUGH THE ADDITIONAL NUMBER. CALLAPP DOES NOT GUARANTEE, AND YOU SHOULD NOT EXPECT, ANONYMITY WITH RESPECT TO THE ADDITIONAL NUMBER AND YOUR USE OF THE ADDITIONAL NUMBER.
- Limitation of Liability
The following provisions shall apply in addition to the provisions set forth in CallApp’s Terms of Service “Limitation of Liability” section.
CALLAPP WILL NOT BE LIABLE FOR ANY DAMAGES OR CLAIMS BY YOU OR ANY THIRD PARTY RESULTING FROM OR IN CONNECTION WITH ANY ATTEMPT TO MAKE EMERGENCY CALLS USING THE ADDITIONAL NUMBER. CALLAPP WILL NOT BE LIABLE FOR ANY DAMAGES (INCLUDING WITHOUT LIMITATION, INDIRECT, CONSEQUENTIAL OR SPECIAL DAMAGES) RESULTING FROM OR IN CONNECTION WITH ASSIGNMENT OR CHANGE OF THE ADDITIONAL NUMBER.
